Airbnb crackdown in Spain: Andalusia introduces more red tape for homeowners wanting to rent to tourists

The Andalusian government is expected to approve a new law on tourist housing this Monday, which will give local authorities the power to “set limits on the maximum number of tourist housing per building or sector.”

Tourism, Culture and Sports Minister Arturo Bernal confirmed the move in an interview. Canal Sur Radio on friday.

According to a draft law released today, the Andalusian government noted that there are 80,000 tourist homes in the Andalusian Tourist Register and acknowledged that the number is “growing every day.”

Government legislation states that local authorities may set limits on the maximum number of tourist accommodations per building or sector.

The administration argues that it provides “legal certainty for the application of rules limiting powers comparable to those applicable to local councils in urban affairs and territorial planning.”

The government goes on to say that its regulations do not “prescribe any specific limitations or restrictions on economic activities for tourist housing, but rather allow municipalities to do so within their powers.”

It added: “Any restrictions that may be established locally will need to be subject to strict scrutiny from a market guarantee and competition perspective.”

Andalusia President Juanma Moreno said on Tuesday that the legislation on tourist apartments is the consensus of the industry and its aim is to ensure quality and better organization.

He added that the new regulations for tourist apartments will contribute to better control and knowledge about the number of active housing units in each period and their actual owners.

Moreno said the new ordinance recognizes the right of local governments to impose restrictions, prohibitions or conditions based on urban planning issues such as location and zoning.

The President said that the registration of real estate as holiday accommodation in the tourist register will be notified to local authorities, who will verify the legality of the city along with the identity of the owner.

“Governments will know which companies professionally manage hosting services.Hosting services will help users and third parties by identifying the actual providers of tourism services regardless of real estate ownership We guarantee our rights,” Moreno said.
