Italian regulator charges OpenAI with breaching data protection laws

Must read

The Italian Data Protection Authority (IDPA) has accused OpenAI of violating European Union (EU) privacy and data protection regulations.

In a statement, IDPA claims that OpenAI’s ChatGPT violates the provisions of the EU’s General Data Protection Regulation (GDPR), the regional bloc’s rulebook for information privacy.

IDPA’s filing followed a “fact-finding” mission in late 2023 to investigate allegations of data scraping by OpenAI. At the time, civil society groups filed a petition with the privacy watchdog alleging that AI developers were involved in collecting several types of personal data without the consent of the owners.

It is important to note that the regulator’s statement does not designate guilt and OpenAI has the right to mount a defense against the allegations. OpenAI has 30 days to file a defense or counterclaim to the report before final determination of the matter.

However, IDPA said it would consult a regional task force of EU privacy regulators before making a final decision. Privacy authorities are also seeking feedback from academia, AI experts, and the general public about monitoring OpenAI.

“After investigating the facts, the authorities reserve the right to take necessary measures even in case of emergency,” IDPA said.

Privacy watchdogs have several options available to them, including imposing hefty fines or banning ChatGPT from Italy altogether. In early 2023, IDPA geo-restricted OpenAI in the country for serious violations of EU data rules, but lifted the ban only after the company disclosed its internal data processing policies to regulators.

Separately from the crackdown on AI companies, Italian regulators have fined the city of Trento $54,000 for violating privacy rules in AI-powered research projects.

Italy strengthensStance towards AI

As leader of the G7 countries over the next 12 months, Italy said it would prioritize AI regulation, aiming to foster a collaborative approach to rule-making. Italy will seek to steer global policy towards job security as the adoption of generative AI tools in the workplace increases.

Building on lessons learned from the EU’s Market in Cryptoassets (MiCA) law and its impact on digital assets, Italian Prime Minister Giorgia Meloni is eyeing the establishment of perfect rules to rein in the operations of AI companies. .

“We are very concerned about the impact of AI on the labor market,” Meloni said. “Today we face a revolution in which human intelligence is in danger of being replaced.”

For artificial intelligence (AI) to function properly within the law and succeed in the face of growing challenges, it must integrate enterprise blockchain systems that ensure the quality and ownership of data input. This makes it possible to ensure data security while also guaranteeing immutability. of data.
