Singapore passed a bill on Monday that would allow “dangerous criminals” to be detained indefinitely even after they have completed their prison sentences.
Under the Enhanced Civil Protection Penalties (SEPP) Act, individuals convicted of serious violent crimes, such as murder or attempted murder, or serious sexual crimes, such as rape or sexual penetration of a minor, have their sentences completed. They are not automatically released at the time of their sentence, but are automatically released at the end of their sentence. ; these criminals will now need approval from the Home Secretary to determine whether they no longer pose a threat to the public.
Minister of Law and Home Affairs K. Shanmugam stressed the need to protect the public from criminals who continue to pose a real danger. He clarified that the decision whether to impose a standard or SEPP sentence rests with the court, which will have discretion in that process.
The Home Office and the Ministry of Justice issued a joint statement highlighting the bill’s aim to better protect the public from dangerous criminals. They cited cases involving serial sex offenders who targeted children and repeat offenders who committed crimes after being released from prison.
However, some experts have expressed concerns about the assessment of criminals. Siraj Shaik Aziz, director of Silvester Legal LLC, questioned how the likelihood of rehabilitation can be accurately assessed when offenders are evaluated in institutions. Labor MP Sylvia Lim also expressed concern that future violence could be inaccurately predicted, which could result in over-detention of individuals deemed dangerous.
